Copyright guide for Camosun College

Copyright is a complex topic. To facilitate awareness and compliance, the college has a dedicated Copyright & Institutional Repository Technician. Working with Director of Learning Services, the Copyright & Institutional Repository Technician provides support to faculty and staff. 

Haydn Lloyd, the Copyright & Institutional Repository Technician, will review all coursepacks prior to printing and can provide direction and guidance on questions related to copyright, fair dealing and open licensing including Copyright LibGuides. 

This guide provides information about Copyright in the context of research and education. It does not provide legal advice, but it will assist members of the Camosun community in making their own decisions based on a better understanding of their rights and responsibilities according to the Canadian Copyright Act. It is everyone’s responsibility to comply with copyright agreements and legislation.

Effective on Dec 30 2022, Copyright protection period of Canada extended by 20 years. The term will be from life of creator/author plus 50 to life plus 70. 

  • Works from a creator/author died before Dec 31 1971 are already on public domain. (Life + 50)
  • Works from a creator/author died on or after Jan 1 1972 will become public domain after Jan 1 2043. (Life + 70)
  • If a work is already on public domain, it will remain as public domain.

Effective August 31 2012, Camosun College has opted-out of any agreement with Access Copyright and will administer its own copyright procedures and controls. Many other Canadian universities and colleges made the same decision following the advice of the Association of Canadian Community Colleges (ACCC).

This decision to opt out was made in light of the Supreme Court of Canada decisions of July 12, 2012 that addressed fair dealing and the passing of the Copyright Modernization Act in June 2012.    

Camosun faculty and staff are required to adhere to the Fair Dealing Policy. If copyrighted material used in a coursepack, in a classroom or on D2L etc. does not meet the standards of fair dealing (excluding materials used under the public domain or creative commons license) faculty will be asked to identify an alternative resource or seek permission for use from the copyright holder and pay any associated royalties. Assistance will be available when permission is required.
